Currently only California, Colorado, Connecticut, Utah and Virginia have enacted comprehensive consumer data privacy laws. The laws have several provisions in common, such as the right to access and delete personal information and to opt-out of the sale of personal information, among others.

CALIFORNIA CONSUMER PRIVACY ACT (CCPA OR CPRA)
The California Consumer Privacy Act of 2018 (CCPA) gives consumers more control over the personal information that businesses collect about them and the CCPA regulations provide guidance on how to implement the law. This landmark law secures new privacy rights for California consumers, including:

The right to know about the personal information a business collects about them and how it is used and shared;
The right to delete personal information collected from them (with some exceptions);
The right to opt-out of the sale or sharing of their personal information; and
The right to non-discrimination for exercising their CCPA rights.

In November of 2020, California voters approved Proposition 24, the CPRA, which amended the CCPA and added new additional privacy protections that began on January 1, 2023. As of January 1, 2023, consumers have new rights in addition to those above, such as:

The right to correct inaccurate personal information that a business has about them; and
The right to limit the use and disclosure of sensitive personal information collected about them.

Colorado Privacy Act (CPA)
(Effective as of July 1, 2023) Senate Bill 21-190 was signed into state law to Protect Personal Data Privacy establishing the Colorado Privacy Act (CPA). The CPA grants Colorado Consumers new rights with respect to their personal data, including the right to:

Access. Consumers have the right to confirm whether a controller is processing their personal data and access such personal data, unless such actions would reveal a trade secret.
Correction. Consumers have the right to correct inaccuracies in their personal data (with some limitation).
Deletion. Consumers have the right to delete personal data provided by or about the consumer.
Opt-out of certain data processing. Consumers have the right to opt out of the processing of personal data for purposes of (i) targeted advertising, (ii) the sale of personal data or (iii) profiling in connection with automated decisions that produce legal or similarly significant effects concerning the consumer.

Connecticut Data Privacy Act
What Rights Do Connecticut Consumers Have? The CTDPA grants consumers a broad swath of rights. Specifically, the CTDPA grants consumers the right to appeal denials of requests by controllers,22 along with the CPA’s right to opt out of processing for either targeted advertising or sales of personal data.23 Similar to other comprehensive privacy laws, the CTDPA grants consumers the following rights:

Access. Consumers have the right to confirm whether a controller is processing their personal data and access such personal data, unless such actions would reveal a trade secret.
Correction. Consumers have the right to correct inaccuracies in their personal data (with some limitation).
Deletion. Consumers have the right to delete personal data provided by or about the consumer.
Data portability. Consumers have the right to obtain a portable copy of their personal data to the extent technically feasible and provided the controller will not be required to reveal any trade secret.
Opt-out of certain data processing. Consumers have the right to opt out of the processing of personal data for purposes of (i) targeted advertising, (ii) the sale of personal data or (iii) profiling in connection with automated decisions that produce legal or similarly significant effects concerning the consumer.

Utah Consumer Privacy Act (UCPA)
(Effective on December 31, 2023) The Utah Consumer Privacy Act requires that data controllers inform consumers when they are processing sensitive information and give them the chance to opt out. Under this law, data controllers are required to allow consumers to opt out of the sale of their personal information or targeted advertising based on the collection of their data.

Virginia Consumer Data Protection Act (VCDPA)
(Effective as of Jan. 1, 2023) The VCDPA law gives Virginians the right to access their data and request that their personal information be deleted by businesses. It also requires companies to conduct data protection assessments to process personal data for targeted advertising and sales purposes.
Opt-out rights Among other consumer privacy rights, the CDPA provides Virginia residents with the right to 'opt out' of the processing of personal data for the following three purposes:

Targeted advertising
Selling personal data
Profiling in furtherance of decisions that produce legal or similarly significant effects concerning the consumer.
